                            Reasons for Exemption
                        
                        
                            Permit Sonoma has determined that the project is categorically exempt from the provisions of the California Environmental Quality Act pursuant to the Provisions of Title 14 of the California Administrative Code, Section 15301 (Existing Facilities), which provides for negligible expansion of an existing use. The proposed day care will increase the current family day care center from 14 children to 20 children and therefore proposes a minor expansion of the existing use. The proposed project is also exempt under Section 15303 (New Construction or Conversion of Small Structures), which provides for the construction of new small structures, because the project involves the construction of a new 1,440 square foot modular classroom.
A categorical exemption is also appropriate because the evidence supports the conclusion the project will not have a significant impact on local traffic conditions as determined by the Focused Traffic Study (W Trans, 12/6/2021) for the project which concluded that the project is presumed to have a less than significant impact on Vehicle Miles Traveled (VMT) as the use would generate fewer than 110 daily trips.
No exceptions listed under CEQA Section 15300.2 apply, including the “unusual circumstances” exception because the evidence in the record supports the conclusion that there is no reasonable possibility the Project will have a significant effect on the environment due to unusual circumstances. The evidence does not support a finding that an unusual circumstance exists and the water analysis and traffic analysis did not identify significant effects on the environment.
