            Pursuant to Section 54234(a)(1) of the Surplus Land Act, and the California Department of Housing and Community Developmentās Surplus Land Act Guidelines, if a local agency, as of September 30, 2019, has entered into a legally binding agreement to dispose of property, and the disposition of the property is completed by December 31, 2022, the local agency is exempt from Articles II and III of the Surplus Land Act Guidelines. The property identified above was subject to a legally binding agreement for its disposal prior to this date, as the City entered into an ENRA on August 1, 2017, as well as an Option Agreement as of June 5, 2018. The project includes declaration of the subject property as exempt surplus lands and does not entitle any development.

                            The City has determined that the designation of this property as surplus does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined by the CEQA Guidelines Section 15378.
